Definitions
In this contract, “Company” refers to SmartNest Systems Pty Ltd, its successors, assigns, or any authorised party acting on its behalf. “Client” refers to the individual or entity engaging the Company to carry out works. “Works” includes all services performed and materials supplied, along with advice or recommendations. “Materials” are those needed to complete the Works. A “Prime Cost Item” is a component whose specification or price is not determined at the time of contract execution, and for which a reasonable estimate has been included. A “Provisional Sum” is an allowance for works not yet defined due to insufficient information at the time of agreement. “Price” denotes the agreed cost of the Works between the Company and the Client.
General
The Client must provide adequate site amenities for Company personnel at no charge. The Client is responsible for informing Company personnel of any safety requirements and potential hazards at the site. Company staff will be in uniform and will supply their own tools unless otherwise arranged. Contract terms shall include reasonable definitions for pricing and materials, and any clause deemed unenforceable shall be severed without invalidating the remainder of the agreement.
Acceptance
Any instruction from the Client or acceptance of completed Works by the Company constitutes agreement to these terms. Where more than one party is identified as the Client, all parties are jointly and severally liable for payment. Once accepted, these terms remain binding unless rescinded according to their own provisions or through mutual written consent. No unauthorised representations by Company agents are valid unless issued in writing by a Company manager.
Installation Work
All installation activities will meet current Building Regulations and standards at the time of execution. Pricing assumes that the existing infrastructure is sound and compliant; any necessary remedial work will incur additional charges. Where practical, cables will be concealed within building structures. In other cases, they will be surface-mounted in a neat fashion. If floors need to be lifted, care will be taken to minimise damage and restore them, though professional refitting may be advisable at the Clients’s expense. Wall chases will be backfilled short of final finish depth, and decoration is excluded. Installation efforts will aim to maintain cleanliness, and estimated timelines will be communicated. Water and power must be supplied at no cost.
Hazardous Materials
Unless specified otherwise, quotations assume a hazard-free site. The Client assumes full responsibility for any delays or costs resulting from hazardous materials present on-site.
Work Site Access
We have based our offer on free and unrestricted access to all required work areas.
Live Work Clause
The Company adheres strictly to safety protocols and does not perform live work near energized conductors unless deemed safe in accordance with AS/NZS 4836:2001 and applicable laws. Procedures may involve isolating parts of the system, which may attract additional fees.
Extras and Variations
Any extras or changes must be approved in writing prior to commencement.

Exclusions
Unless specifically listed in the scope of works, the Company excludes electrical rectification outside of AS3000/AS3008 standards, builder’s work, asbestos removal, fire cable integration, proprietary control modifications, trenching, demolition, weatherproofing, union-related allowances, and any statutory or council fee payments. No responsibility is taken for equipment not supplied by the Company or alterations to proprietary systems.
